That is EXACTLY how you will be sued. We have so many stubborn people in our court who come in guns blazing, ranting and raving about how they're being deceived and their case is fraud, etc etc etc because they never had an account with their Plaintiff. Visa is not going to sue you. Mastercard is not going to sue you. Chase is not going to sue you. They will refer your account to a collection agency. If you don't comply they will send the account to an attorney who will file suit against you. If you still don't comply you will have an incredibly inflated judgment against you. They will add in all sorts of penalties, fees and costs. It's best you use your energy to pay this off rather than trying to fight it in court. You will lose.

I am in the same boat they will keep selling until you pay no matter when it says it was charged off. I had to go to court but after the company found out I had no job they could not do anything to me so they accepted what I originally offered to pay a month so call them and tell them you want to pay something a month most creditors won't go to court if you offer to pay something a month. Asset acceptance usually works with you. good luck

Yes. You owe them the money now and they can take you to court. Call them and ask if you can set up a payment arraignment. They might let you. Do something about it now before you go to court.

Yes they can sue you, it's pretty routine actually. YOu can fight it if the debt is not valid - meaning you never originally owed it to the originating creditor or if you can show you've been paying on a regular basis.
